It is essential that every effort be made to draft leases in a clear and concise manner. I believe that leases should be as complete and as thorough as possible. As a Landlord investing in a comprehensive lease which can be used on successive occasions is a necessary step in ensuring smooth and enduring relationships with tenants. If you are a tenant many commercial leases contain clauses which can be onerous and expensive. For example restoration clauses are often inserted into commercial leases which require the tenant to restore the premises to its original condition at the expiry of the term. Depending on the nature of the tenants improvements and the condition of the premises these clauses can often result in litigation as the cost to restore can be very expensive. In most instances i recommend a building condition survey report be done at a leases inception which report comprehensively documents the existing condition and state of repair of the Leased premises.
